Tomorrow you’ll have a chance to weigh in on whether or not the state should require unanimous jury verdicts in felony cases, amendment two on the ballot. The option passed the House 84 to 15 and has received widespread bi-partisan support behind a message that former District Attorney Ed Tarpley says is clear.

Cut 4 (11) “…in Louisiana.”

The amendment has the support of groups of the political spectrum and US Senator Bill Cassidy has voiced his support.

But several current DAs have reservations about the change. Tangipahoa, Livingston, and Helena DA Scott Perrilloux says the current law is delivering justice just fine, and the proposed change would be a burden on victims.

Cut 5 (08) “…done again.”

Supporters like Tarpley say the law is racist in nature and has a disproportionate effect on minority defendants who lose the ability to have a jury of their peers. Perrilloux says that’s not true, and that Apodaca vs. Oregon settled that question.

Cut 6 (05) “…it’s legal.”

But Tarpley says that 1972 4-1-4 decision is remarkably flawed in that it required unanimous juries in federal cases but allowed states to make their own call on it. He says the founders thought of it as vital for American justice.

Cut 7 (10) “…unanimous”

Cut 11 (08)   “…news for them.”

Pinsonat says many voters may be undecided when it comes to the Secretary of State’s race due to a lack of campaign funding for the candidates.

Cut 12 (08)  “…about the candidates.”
